Indian nationals who are filing EB5 from USA, including H1B, L1 & F1 visa holders, can get EAD (Employment Authorization Document) card within 4 months of filing of their I526E. This rule was not in place prior to RIA (Reforms & Integrity Act), 2022. However, with the amendment, applicants can now opt for concurrent filing, which means an applicant can file I-756, I-131, & I-484 all at the same time, along with their I-526E.

EAD & AP cards are now being issued together, combo card, as a result of which, anyone pursuing EB5 & as long as they are filing while residing in USA, will be able to enjoy both these cards in a short span of 4 months (maximum of 6 months, but not beyond).

An EB5 applicant can work anywhere he likes, shift jobs, start own business, i.e. be self-employed, study, or do nothing to retire and sit at home, as long as EAD is in place. Thus, the EAD card is a magic for those who otherwise had to wait for years, ever after investing in EB5.
